End User License Agreement

TERMS OF USE OF ENABLER III LINUX USB DRIVER - PLEASE READ CAREFULLY

Use of the Enabler III Linux USB Driver ("Software Driver") is subject to the terms and conditions set forth below, and may be subject to additional terms and conditions as set forth in Enfora's Technical Support Policy (posted on this website) and/or any written agreement between the user and Enfora. By using the Software Driver you confirm your (and your company's) agreement to all applicable terms and conditions.

The Software Driver is provided AS IS. Enfora makes no warranty or representation with respect to the merchantability, suitability, or functionality of the software driver, or non-infringement of any third party rights. The user of the Software Driver assumes all risk (known or unknown) from its use. Enfora shall have no obligation to support or maintain the Software Driver.

Enfora and/or its licensors (as applicable) reserve(s) all rights in the Software Driver. The user acknowledges that the Software Driver is provided by Enfora in source code form ("Source Code"). The user shall have only a personal, non-transferable, non-exclusive, revocable and limited license to (a) load the Source Code on a PC and use the Software Driver to communicate with an Enfora product from the Enabler IIIG family of products ("Enabler IIIG Product"), and (b) compile the Source Code into executable code and distribute the executable code in an end-user product containing an Enabler IIIG Product. No other use or distribution of the Software Driver is permitted.

The user may modify the Source Code, and use the modification(s) as permitted herein, provided the user promptly discloses all such modifications to Enfora, and assigns to Enfora all of the user's rights to such modifications. The user must keep the Source Code strictly confidential and may disclose it only in confidence to its employees or contractors who require access to the Source Code in connection with the permitted uses.

IN NO EVENT WILL ENFORA BE RESPONSIBLE FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES AS A RESULT OF THE USE OF THE SOFTWARE DRIVER. ENFORA'S MAXIMUM LIABILITY FOR ANY CLAIM BASED ON THE SOFTWARE DRIVER SHALL NOT EXCEED FIFTY U.S. DOLLARS ($50).
